I. What is a trademark?

Under EU trademark law, “trademarks may include any sign that can be presented physically and separately in terms of words, including personal names, designs, letters, numbers, shape or packaging of goods, capable of distinguishing the goods or services of one subject from the goods or services of other subjects”.

In view of the current Vietnam Intellectual Property Law, trademarks are defined as "signs to distinguish goods and services of different organizations and individuals".

Thus, under the most general perspective, a trademark can be considered as any identifiable sign to identify and distinguish goods and services of different entities.

Currently, a trademark is of great interest in both industrial property and commercial markets. It is used for two main purposes: to determine the origin of goods or services and to distinguish those from others.

II. Process of trademark registration in Vietnam

The trademark registration process is regulated and implemented according to the following steps:

Receiving application for trademark registration

Application forms can be submitted directly or through postal way to the Office of Intellectual Property Department in Hanoi or Representative Offices in Ho Chi Minh City and Danang.

Appraising the structure of the registration form

Check for compliance with formal rules, thereby making a conclusion whether the application is considered valid.

Release notice to accept/ refuse the application

-In case the application is valid, the National Office of Intellectual Property will release a notice of acceptance of the application;

- In case the application is invalid, a refusal notice will be released.

Publication of application

Valid applications will be published in the Industrial Property Gazette.

Appraising the content of the registration form

Evaluating the protection ability of the object stated in the application according to the protection conditions, thereby determining the corresponding protection scope.

Issuing decisions to grant/ refuse to grant protection titles:

-If the object stated in the application fails to meet the protection requirements, the National Office of Intellectual Property will issue a decision to refuse to grant the protection title;

-If the object stated in the application meets the protection requirements and the applicant pays the full fee, the National Office of Intellectual Property will issue a decision to grant the protection title, record it into the National Register of industrial property, and publish it in the Intellectual property Gazette.

 Composition and number of records:

-The record includes Declaration (02 sample sheets); Model of trademarks (09 samples with size 80x80 mm); Relevant documents (if necessary); vouchers of payment for charges.

- Number of records: 01.

III. Package registration services
